Terms of service

A service that sells freedom from paperwork should not open with nine pages of it. Almost everything below follows from two facts: your account is a token nobody can recover, and the money is crypto that cannot be reversed.

1. The agreement

Creating an account or sending a message accepts these terms, the acceptable use policy and the privacy policy. Together they are the whole agreement between us. There is no separate contract to sign, no order form, and no salesperson with authority to promise you something that contradicts this page.

You must be legally able to enter into an agreement, and you must be permitted to send commercial messages in the markets you send to. We do not verify either, which does not make them optional.

2. Your account

  • The token is the account. Anyone holding it is you, as far as this platform can tell. We store only its hash and cannot recover it, reset it, or verify a claim to it.
  • Losing it loses the balance. This follows directly from the previous point. It is the cost of an account that cannot be read out of a stolen database, and it is not a support matter.
  • API keys spend your balance. Keep one per system that sends, and revoke a key the moment it might have leaked.
  • Multiple accounts are fine. Nothing links them and nothing prohibits them.

3. Credit and billing

  • Credit is prepaid. You fund an account in cryptocurrency and spend the balance at the published rate for each destination, per message segment. Minimum top-up $40.
  • Credit is not refundable and not transferable. There is no payment instrument on file to reverse, and returning coin to an address we merely observed a payment from would be a guess about ownership.
  • Credit does not expire and carries no subscription, seat or minimum monthly spend.
  • Undeliverable segments are refunded to your balance automatically when a campaign settles. Segments accepted by a carrier are billed whether or not the recipient reads them.
  • Prices can change. Carrier pricing moves. A change applies to messages sent after it, is published on the rate card the day it takes effect, and is listed in the changelog. It never applies backwards.
  • Rates are quoted in USD and the amount of coin an invoice asks for is fixed for that invoice's 30-minute window.

4. What we provide

Access to bulk SMS routes across the destinations on the rate card, a dashboard, an API, and delivery receipts as carriers report them. We provide it on commercially reasonable efforts.

  • No SLA with credits attached. Selling one on an account with no contract and no identity behind it would be theatre. Current state and incident history are on the status page.
  • Delivery is not guaranteed. Carriers filter, networks fail, and handsets are switched off. What we guarantee is that you are not billed for a segment reported undeliverable.
  • Sender IDs are carried where routes carry them. A carrier that rewrites your sender ID is exercising its own policy, and coverage says where that happens.
  • Routes change. We may change carriers or aggregators for a destination at any time, without notice, and generally to preserve delivery.

5. Acceptable use

The acceptable use policy is part of these terms. In summary: you are responsible for the lawfulness of your messages and for consent in every market you send to, and a short list of categories — phishing, impersonation of banks or government services, payment fraud, malware, content involving minors — ends an account immediately, without refund.

You indemnify us against claims arising from your messages, your recipient lists, and your use of a sender ID you were not entitled to use.

6. Liability

To the fullest extent the law allows, our total liability for any claim is limited to the credit balance on your account at the time the claim arose. We are not liable for indirect or consequential loss — lost revenue, lost customers, or lost opportunity — including where a message was delayed, filtered or never delivered.

The service is provided “as is”. Nothing here excludes liability that cannot lawfully be excluded.

7. Ending it

  • You: stop sending, or abandon the token. There is nothing to cancel because there is no subscription, and no notice period because there is no term.
  • Us, for refused traffic: immediately and without refund, as set out in the acceptable use policy.
  • Us, otherwise: if we discontinue the service, remaining balances stay spendable for 30 days from the announcement.

8. Changes

We may update these terms. Material changes are dated at the top of this page and listed in the changelog, and continuing to send after that accepts them. We cannot notify you by email, for the same reason we cannot ask you for one.

These terms are governed by the laws applicable at our place of establishment. Nothing in this document is legal advice about your own obligations in the markets you send to.
